Please read these Terms of Service ("Terms") carefully before using the MassAffect mobile application operated by Exertronik LLC ("we", "us", or "our").
By creating an account or using MassAffect, you agree to be bound by these Terms. If you do not agree, do not use the app.
MassAffect is a fitness application that uses AI to generate personalized workout plans and track your exercise progress. The app is provided for informational and fitness-tracking purposes only.
MassAffect is not a substitute for professional medical advice, diagnosis, or treatment. Always consult your physician or qualified health provider before beginning any exercise program. If you experience pain, dizziness, or discomfort during a workout, stop immediately and seek medical attention.

All content, features, and functionality of MassAffect — including but not limited to text, graphics, logos, and software — are the property of Exertronik LLC and are protected by copyright and other intellectual property laws.
Workout plans and exercise recommendations are generated by artificial intelligence. While we strive for accuracy and safety, AI-generated content may contain errors. You use AI-generated workout plans at your own risk and should always exercise sound judgment regarding weight selection and exercise form.
The following terms apply when you obtain MassAffect through the Apple App Store. They are required by Apple's Developer Program License Agreement and supplement these Terms with respect to App Store distribution. If any provision in this section conflicts with another provision in these Terms, this section governs as to App Store distribution.
Acknowledgment. You and Exertronik LLC acknowledge that these Terms are concluded between you and Exertronik LLC only, not with Apple Inc. ("Apple"), and that Exertronik LLC, not Apple, is solely responsible for MassAffect and its content.
Scope of License. The license granted to you for MassAffect is a non-transferable license to use MassAffect on any Apple-branded products that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (including via Family Sharing or volume purchasing, where permitted).
Maintenance and Support. Exertronik LLC is solely responsible for providing any maintenance and support services for MassAffect. Apple has no obligation whatsoever to furnish any maintenance or support services in connection with MassAffect.
Warranty. Exertronik LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of MassAffect to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for MassAffect to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to MassAffect, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Exertronik LLC's sole responsibility.
Product Claims. Exertronik LLC, not Apple, is responsible for addressing any claims by you or any third party relating to MassAffect or your possession or use of MassAffect, including but not limited to: (a) product liability claims; (b) any claim that MassAffect fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
Intellectual Property Rights. If any third party claims that MassAffect or your possession and use of MassAffect infringes that third party's intellectual property rights, Exertronik LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Legal Compliance. You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third Party Beneficiary. You and Exertronik LLC acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
To the fullest extent permitted by law, Exertronik LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, arising from your use of the service.
We may suspend or terminate your access to the service at any time, with or without cause. You may delete your account at any time from within the app.
We reserve the right to modify these Terms at any time. Continued use of the app after changes constitutes acceptance of the updated Terms.
